At Foremost Hat, we encourage our customers to express their brand identity and creativity through unique custom headwear and apparel. We support reasonable creative expression while maintaining standards designed to protect intellectual property rights, prevent harmful content, and ensure efficient production.
This policy applies to all custom orders, including embroidery, printing, patches, labels, private labeling, and other personalized decoration services.
WE PLAY BY THE RULES
OUR POLICY: Foremost Hat supports creative expression while reserving the right to reject customization requests that promote hate, violence, unlawful activity, or harm toward others.
Foremost Hat must also respect the intellectual property rights of teams, leagues, players, brands, organizations, and other third parties. We therefore do not accept logos, artwork, trademarks, or designs that are known to be unauthorized, infringing, or otherwise unlawful.
Design Submission & Rights
We offer a flexible design submission process. Artwork may be submitted through email, official contact forms, online consultation, or our Online Customizer.
By submitting artwork or placing a custom order, the customer agrees to the following:
Guarantee of Rights
The customer represents and warrants that they own, license, or otherwise have appropriate authorization to use all logos, artwork, trademarks, graphics, text, and other materials submitted for customization.
Customer Responsibility
The customer is responsible for ensuring that submitted artwork does not infringe upon any third-party intellectual property rights.
Foremost Hat may request evidence of authorization when reasonably necessary and reserves the right to decline any design or order that may violate applicable law or third-party rights.
Indemnification
The customer agrees to indemnify, defend, and hold harmless Foremost Hat, its affiliates, officers, employees, and representatives from claims, damages, liabilities, costs, and reasonable legal expenses arising from:
- The customer's breach of this policy; or
- Claims that customer-supplied artwork, logos, trademarks, designs, or other materials infringe upon third-party intellectual property rights.
Production Role
Foremost Hat acts as a custom product manufacturer and decoration service provider. Acceptance or production of customer-submitted artwork does not constitute a determination or endorsement that the artwork is legally authorized for use.
Technical Adjustments
Foremost Hat reserves the right to make reasonable technical adjustments to artwork when necessary for embroidery, printing, patches, or other production processes.
These adjustments may include changes to line thickness, small details, stitch construction, sizing, or other production-related elements intended to improve manufacturability and finished-product quality.
Material differences and the nature of embroidery, printing, and other decoration methods may result in reasonable variations between digital artwork, mockups, samples, and finished products.
Custom Production & Sample Approval
Sample Review
After payment and artwork preparation, Foremost Hat may provide a digital proof, sample photo, embroidery sewout, or physical sample, depending on the order and decoration method.
The customer is responsible for carefully reviewing all applicable details, including:
- Artwork and spelling
- Logo size and proportions
- Placement
- Colors
- Decoration method
- Patch shape and border
- Embroidery appearance
- Overall design
48-Hour Approval Rule
Customers must provide approval or requested revisions within 48 hours after the sample, proof, or sample photos are provided.
If Foremost Hat does not receive approval or revision instructions within 48 hours, the sample will be considered approved by default, and the order may automatically proceed to bulk production based on the provided sample and specifications.
The production lead time will begin from the date of customer approval or the expiration of the 48-hour approval period, whichever occurs first.
After Sample Approval
Once a sample has been approved—either expressly by the customer or automatically after the 48-hour review period—the custom order is considered final and approved for production.
Custom orders cannot be canceled or modified after sample approval.
Approval confirms acceptance of the applicable artwork, dimensions, placement, colors, decoration method, and overall appearance shown in the approved sample or proof.
Cancellation Before Sample Approval
If a customer requests cancellation after customization work or sample production has begun but before final sample approval, applicable costs already incurred are non-refundable.
If cancellation is requested for personal or subjective reasons—including, but not limited to, dissatisfaction with the appearance, embroidery effect, logo size, color, placement, or personal preference—the customer will be responsible for:
- Applicable digitizing and/or setup fees; and
- A 10% cancellation/processing fee based on the order value, with a minimum charge of $10.
Costs already incurred for physical samples, custom patches, labels, special materials, private-label components, shipping, or other custom production preparation may also be non-refundable.
Changes to Custom Orders
Before final sample approval, customers may request reasonable changes to artwork, placement, decoration method, or other customization specifications, subject to production feasibility.
If the requested change requires a decoration method, material, component, or production process that costs more than the original order, the customer will be responsible for paying the price difference before the revised sample or production can proceed.
Changes may require a new sample or proof and may reset the approval process.
Any requested modification may also affect the estimated production and delivery timeline.
After sample approval, no further changes to the custom order can be accepted.
Unproducible Orders & Communication
If an order cannot be produced according to the submitted specifications, Foremost Hat will attempt to contact the customer to discuss alternative artwork, products, materials, or decoration methods.
If customer action is required and we are unable to obtain the necessary information or approval, the order may be placed on hold for up to 30 calendar days.
If no response is received within 30 calendar days, Foremost Hat may cancel the order. Any refund will be subject to deductions for applicable digitizing, sampling, setup, special materials, or other costs already incurred.
Production Lead Time & Shipping
Estimated production times for custom orders begin after sample approval, including approval by default following the 48-hour review period.
Standard production timelines may vary depending on:
- Order quantity
- Product availability
- Decoration method
- Number of decoration locations
- Custom patches or labels
- Special materials
- Sample revisions
- Seasonal production volume
Any production or dispatch date provided is an estimate unless otherwise expressly guaranteed in writing.
Once an order has shipped, please allow approximately 24–48 hours for tracking information to appear or update in the carrier's system.
Carrier transit time is separate from Foremost Hat's production lead time.
Promotional Use of Finished Products
Unless otherwise agreed in writing before production, Foremost Hat may photograph completed custom products and use photographs or digital representations of those products in its normal marketing and promotional materials, including its website, social media, catalogs, and sales materials.
Customers requiring confidentiality should request and execute an applicable Non-Disclosure Agreement (NDA) before production begins.
Governing Law & Jurisdiction
This policy and applicable custom orders shall be governed by the laws of the State of California, without regard to its conflict-of-law principles.
Any dispute arising from or relating to this policy or a custom order shall be subject to the jurisdiction of the appropriate courts located in Los Angeles County, California, unless the parties mutually agree in writing to another dispute-resolution procedure, including arbitration.
Policy Ownership & Responsibility
This policy is issued and maintained by Smart Head Ltd.
Smart Head Ltd. is responsible for the administration and enforcement of this policy and, where applicable, acts as the data controller for purposes of applicable data protection laws.
By submitting artwork, making payment, approving a proof or sample, or otherwise authorizing Foremost Hat to proceed with a custom order, the customer acknowledges and agrees to this Customization Policy.
