We pride ourselves on the customization services offered to all B2B wholesalers, and we do not limit reasonable expressions or statements.

WE PLAY BY THE RULES

OUR POLICY: Our customization policy is designed to promote free expression while protecting against expressions of hate or the promotion of harm toward others. Customer order requests will be honored if they fall within these policy guidelines. Foremost Hat must also ensure that the rights of any team, player, or organization are not infringed upon.

Design Submission & Rights

We offer a flexible design process to suit your business needs. We accept designs submitted via email, our official contact forms, or through our online consultation chat. You may also use our Online Customizer tool to place your order directly.

By submitting your designs to us, you agree to the following terms:

  • Guarantee of Rights: The customer guarantees that the provided logos and patterns do not infringe upon the intellectual property rights of any third party. You must possess ownership or express written consent for all artwork submitted.
  • Assumption of Liability: In the event of copyright disputes arising from the production of customer-specified content, the customer shall assume full legal responsibility and all economic compensation (including but not limited to attorney fees, court costs, and financial losses). If Foremost Hat is subject to legal action due to a customer's unauthorized use of a trademark or design, the customer shall be solely responsible for all resulting consequences.
  • Default Effectiveness: The completion of an order (including the payment of a deposit or the confirmation of a sample/draft) shall be deemed as the customer's signature and agreement to this policy.
  • Processing Stance: Our company acts solely as a contract manufacturer. We are under no obligation to verify the authenticity of copyrights, and the act of production does not constitute an endorsement of the legality of the logo.
  • Modification Rights: Foremost Hat reserves the right to modify or optimize designs for technical production requirements to ensure the highest quality embroidery or print.
  • Promotional Usage: Foremost Hat reserves the right to use photos or digital representations of the finished customized products in our normal promotional channels (including but not limited to our website, social media, and catalogs) unless a non-disclosure agreement (NDA) is specifically requested and signed prior to production.

Based on the above customization policy, we do not accept any custom logos or designs that are unauthorized, infringing, or lack clear and legitimate intellectual property rights.


Indemnification & Hold Harmless

Customer agrees to indemnify, defend, and hold harmless Foremost Hat, its affiliates, officers, and employees from and against any and all claims, damages, liabilities, costs, and expenses (including, but not limited to, reasonable attorneys' fees, compensation for loss of brand reputation, and financial losses) arising out of or related to:

  • (a) Customer's breach of any terms or conditions of this Agreement;
  • (b) Any claim that the designs, logos, or artistic materials provided by the Customer infringe upon the intellectual property rights (including, but not limited to, trademarks, copyrights, patents, or trade secrets) of a third party.

Governing Law & Jurisdiction

The validity, interpretation, and enforcement of this Agreement shall be governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute, claim, or litigation arising out of or related to this Agreement or customer’s custom orders shall be submitted to the courts of competent jurisdiction in Los Angeles County, California, or resolved through arbitration as mutually agreed upon by both parties.

Custom Production Process

To ensure efficiency and maintain our production schedule, we strictly adhere to the following workflow for all customized orders:

  • Sample Approval Process: Once your payment is successfully processed, we will prepare a digital or physical sample for your review. It is the customer's responsibility to review and approve the sample promptly.
  • The 3-Day Default Rule: To avoid production delays, you must provide your confirmation or feedback within 3 business days of receiving the sample. If we do not receive a response within this timeframe, we will proceed with mass production based on the default design, including the provided patterns, dimensions, positioning, and technical craftsmanship. Foremost Hat will not be held liable for any deviations that the customer might have wished to change after this period.
  • Unproducible Orders & Communication: In the event that an order is technically unproducible and we are unable to reach you for clarification or design adjustments, we will hold the order for 30 calendar days. If no contact is established after 30 days, the order will be cancelled, and a refund will be issued to your original payment method.
  • Production Lead Time & Dispatch: Please note that the estimated dispatch date for custom orders is calculated from the date of sample approval (or from the 3rd day of the default approval period), rather than from the date the order was initially placed. Standard production typically takes 15–25 business days following this approval.

Policy Ownership & Responsibility

This policy is issued and maintained by Smart Head Ltd. Smart Head Ltd. is the responsible entity for the administration and enforcement of this policy and, where applicable, acts as the data controller for the purposes of applicable data protection laws.
